From the many inquiries we receive, there are often questions like, “We are hiring foreign nationals but what should we do?” “We are interviewing this foreign national, but can they get a visa with these conditions?”
When hiring a foreign national, there are two cases:
- the applicant (the foreign national who is planned to be hired) is not in Japan
- the applicant is already residing in Japan
Case 1: The applicant is not in Japan
In this case, the company hiring the applicant must become their sponsor and apply for the Certificate of Eligibility (COE). When applying, the sponsoring company must first submit an application form to the Immigration Bureau of Japan. Once the certificate (COE) is issued, the foreign national employee must apply for a visa at the Embassy of Japan in their home country. Finally, the employee can then enter Japan with the visa and the COE.
Case 2: The applicant is already residing in Japan
In this case, first, confirm what type of residential qualification the applicant possesses. The steps needed to be followed for the application is different. For example, if the classification is “Student”, documents that certify their major or academic background (Certification of Enrollment, Transcript of Academic Record, etc.), a document showing the proof of employment, and company information are needed. In addition, if they already possess a qualification for employment (a "Engineer/Specialist in Humanities/International Services" visa, etc.), this is considered a job change, and the details of the new job must match the existing visa's residential qualifications.
When proceeding with the application, there can be many sudden hurdles. Discovering that the applicant actually has not fulfilled employment qualifications, having lack of documents, etc., are some of them. If you are considering hiring a foreign national, please consult IMS.
