Last week we were at the mercy of humidity, sudden rains and sunny spells, and now we are almost at the end of May. The rainy season seems to start earlier and earlier every year. I am afraid that spring will be gone by the time today's children become working age.
Today, I would like to explain about company establishment and the Business Manager visa. At IMS, we often receive inquiries about establishing a company or obtaining a Business Manager Visa from those who currently have a "Engineer/Specialist in humanities/International services" visa or other status of residence. The Business Manager visa is appropriate for essentially three situations:
- Start and manage a business in Japan, or engage in management of the business (entrepreneurship)
- Activities to engage in or manage a business already in operation in Japan
- Activities to manage the business on behalf of persons (including corporations) who operate the business in Japan, or to engage in management of said business
If you want to establish a new company and obtain a Business Manager Visa, #1 above applies. In order to obtain this visa, a comprehensive judgment will be made based on the scale of the business, being able to secure an office, and the sustainability of the business, etc.
Requirements
If you are a foreign national preparing to start a business with the intention of obtaining a Business Manager Visa, please be aware of the following requirements:
- Hire two or more full-time employees who reside in Japan.
- The amount of capital or the total amount of investment is 5 million yen or more.
- Other activities which are recognized as being equivalent in scale to items 1 or 2.
Things to Note
In particular, if you are not a mid- to long-term resident of Japan and you currently reside in a foreign country, you will face the following two hurdles:
- Securing an office
- Bank transfer for establishment registration
When securing an office in Japan, there is a lot of communication with real estate agents; in some cases, the landlord may be reluctant to let you use the office unless you are Japanese. In addition, when registering the establishment of a company, it is necessary to transfer the capital to a bank in Japan, so a Japanese bank account is required.
In light of the above, I think it would be a good idea to find a reliable collaborator in Japan if you are considering establishing a company overseas.
As for all statuses of residence (except for Permanent Residence), once you have obtained this visa, it is not automatically continuous. Your application should be made in a manner with content that anticipates future renewals, especially if you are going to be living a life in Japan. Otherwise, come renewal, your situation may not be favorable anymore.
