We received an inquiry from a customer whose application for Permanent Residence was rejected and was considering reapplying. In this blog, I would like to explain about this “reason of rejection.”

Rejected for Permanent Residence

Like this customer, the Permanent Residence application of many people are rejected. The reason differs depending on the individual, but when the Permanent Residence application is rejected, first, the notice of rejection (不許可通知書) comes in a brown envelope from the Immigration Bureau.

※When the brown envelope arrives from the Immigration Bureau after applying for Permanent Residence, it is not always a notice of rejection, so please be careful. When additional documents are needed, a "notification for additional documents" (追加資料提出通知書) also comes in a brown envelope. Please make sure to open the envelope and check what is inside.

The content of the rejection notification is mainly one or the other of the 2 following;

  • Your situation is not recognized as being applicable under Article 22-2 paragraph 〇 of the Immigration Control and Refugee Recognition Act.
  • Looking at your past residence records, your situation is not recognized as being applicable under Article 22-2 of the Immigration Control and Refugee Recognition Act.

Even if you get a notification stating the matters above, an ordinary person will have no idea why they were rejected. Therefore, if you receive a rejection notification, you should go to the Immigration Bureau and confirm the reason of rejection, and understand exactly why your application was not accepted.

Make Sure to Verify the Reason!

When considering to re-apply, that reason of rejection is essential. The reason will help you judge whether you can re-apply immediately, or if you should wait a few years before re-applying, etc.

The Permanent Residence application of our customer, who we received the inquiry, was rejected 3 times. For the first 2 times, he did not understand why he was rejected, but reapplied anyways and got rejected again. That is only natural. If you were rejected but do not know the reason, you will not be permitted no matter how many times you re-applied.

Some cannot go to confirm the reason because they are worried about their Japanese. Some hesitate, worrying that the rejection of their application will affect their visa. However, there is no need to worry. When going to the Immigration Bureau to confirm, an Administrative scrivener, like us, is allowed to accompany you. If you are worried of going alone, please consult us, at IMS. Also, the rejection of your Permanent Residence application has no effect on your present visa. Of course, if your status of residence was revoked or if you got an order of deportation, that is another story.

Like I have mentioned above, if your Permanent Residence application is rejected, please do not forget to confirm and acknowledge the reason. Permanent Resident Japan Requirements

If you have a work visa

  1. Be of good conduct
    • No delinquent payments of resident tax, national health insurance, etc., no traffic violations or punishments such as imprisonment or fines, etc.
  2. Have sufficient assets or skills to make a living
    • Have an annual income of at least 3 million yen, own a home, etc.
  3. Continuous stay in Japan of 10 years or more, 5 years or more of which were on a working visa status
    • No more than a few months out of Japan in a 10-year period, etc.
  4. The current status of residence must have a period of stay of 3 or 5 years
    • If you have a visa with a 1-year period of stay, you cannot apply for a permanent residence permit even if you meet the above conditions

If you have a Highly-Skilled Professional visa, or meet the qualifications of a Highly-Skilled Professional

  1. Be of good conduct
    • No delinquent payments of resident tax, national health insurance, etc., no traffic violations or punishments such as imprisonment or fines, etc.
  2. Have sufficient assets or skills to make a living
    • Have an annual income of at least 3 million yen, own a home, etc.
  3. Be in possession of 70 points or more, according to the highly-skilled professional point calculation table, AND have been in possession of 70 points or more 3 years prior
  4. Be in possession of 80 points or more, according to the highly-skilled professional point calculation table, AND have been in possession of 80 points or more for at least the last 1 year

If you have a Spouse of Japanese Resident visa, Spouse of Permanent Resident visa, or Dependent visa

  1. Be in a bona fide marriage for a continuous 3 years or more, and have lived in Japan for at least 1 continuous year
    In the case of biological children, must have lived in Japan for at least 1 continuous year
  2. The current status of residence must have a period of stay of 3 years or more
    • If you have a visa with a 1-year period of stay, you cannot apply for a permanent residence permit even if you meet the above conditions
